Our client requested that the surveillance continue for the rest of the week. Over the following days, a similar pattern emerged: the employee was performing professional tasks for this competing company. Throughout the investigation, photographs were taken to document her movements and activities.

Results and Legal Consequences

The evidence obtained allowed for the creation of a detailed and chronological report. This report highlighted the recurrence of the employee’s professional activities, confirming that she was working for a competing company while on sick leave.

Based on these findings, our client was able to demonstrate that the employee had violated several contractual obligations, including the duty of loyalty and the non-compete clause. These serious breaches justified a dismissal for gross misconduct, in accordance with applicable legislation.
